This report explores whether search and seizure laws under the Fourth Amendment of the US Constitution permits warrantless searches of laptop computer content and other electronic storage devices at US borders. The author raises privacy interests and a range of policy concerns to determine whether reasonable suspicion must justify a warrantless border search. The report concludes that laptops present a challenge to the US' ability to control what enters its borders, as the storage capacity can be used to smuggle illegal materials.
