This report describes and analyzes two legal mechanisms governing the establishment of the US National Counterterrorism Center (NCTC). The purpose of this report is to outline the commonalities and potential differences between the Executive Order 13354 (EO 13354) and the Intelligence Reform and Terrorism Prevention Act (PL 108-458), both enacted in 2004. The report further analyzes the complexities and implications of the relationship between the NCTCs director and the director of National Intelligence (DNI). The author states that the US Congress should expand its legal oversight over the NCTC.
