This report discusses US military commissions, which pertain to the detention, treatment, and trial of certain non-citizens in the war against terrorism, and how they differ under the Military Commissions Act (MCA) 2009 as compared to the MCA 2006. After reviewing the implementation history of military commissions in the armed conflict against Al Qaeda and associated forces, the report provides an overview of the procedural safeguards provided in the MCA.
