This paper discusses the problems facing the “Spitzenkandidaten” process, introduced in 2014, for selecting the president of the European Commission. The author maintains that the technical and legal arguments being advanced during the 2014 selection process by various factions against the lead candidates for the post are actually a result of political choices and an increasingly confrontational climate between the European Council and the European Parliament.
