This commentary discusses the implications of the European Court of Justice's deliverance of its opinion of the accession of the European Union to the European Convention of Human Rights in December 2014. The authors state that in the opinion of the Court of Justice, the EU's accession to the ECHR, which would place the EU under the external oversight of the European Court of Human Rights in Strasbourg, is incompatible with EU law on a number of grounds and that this has blocked the accession.
