This paper discusses the US and European differences toward international law in light of the 2009 review conference for the International Criminal Court (ICC). The article goes beyond the unilateralist versus multilateralist debate to ask whether globalization and the threat of terrorism fundamentally changed the environment in which international law functions or whether the emergence of the US as the sole superpower affected the international legal regime. They conclude by providing a set of policy recommendations.
