While geopolitical considerations still influence the public debate about Nord Stream 2, in the EU, the topic has shifted to a rather technical discussion of energy market regulation. Indeed, this Policy Perspective contends that within the political organs of the EU, the question is no longer whether the building of the pipeline should continue, but instead how it will be operated following construction. However, in its search for a new specific regulatory framework to cover the pipeline, the Commission has found itself tangled in a web of legal inconsistencies.
