This paper discusses the implementation of the Optional Protocol to the UN Convention against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment (OPCAT) in federal and other decentralized states. It sets out the key elements of OPCAT, identifies the range of ways in which states may be decentralized and analyzes issues arising from the implementation of OPCAT in federal and other decentralized states. It notes that in most contexts, cooperation between the different levels of government is politically feasible and can allow for the effective nationwide implementation of OPCAT standards.
