This paper outlines the main risk factors and situations to which lesbian, gay, bisexual, transgender and intersexed (LGBTI) persons are exposed when they are deprived of their liberty in the criminal justice system. The authors argue that LGBTI persons in detention are in a situation of particular vulnerability and at risk of human rights violations and abuses – including by fellow detainees. They propose possible avenues of action that could be taken by monitoring bodies.
