This opinion paper discusses the need for a harmonization of the different justice systems in Somalia: formal judiciary structures, the traditional, clan-based system, the growing number of Sharia courts, civil society initiatives, and ad hoc mechanisms established by militia factions. The author recommends that Somalia should not adopt one justice system to the detriment of the others, but that international assistance efforts to promote the rule of law in Somalia should be grounded in a broad-based dialogue to reach a consensus between the Somali elite and the public.
