This paper assesses the implications of the Reform Treaty for the common EU Area of Freedom, Security and Justice and offers some suggestions to help avoid the inherent hazards. The first section offers a concise overview of the most relevant innovations in the area of freedom, security and justice. The second section assesses exceptions and derogations applicable to this renewed institutional architecture. The third section presents a critical analysis of the implications that may arise from the application of exceptions and differentiation in the building of a common European Area of Freedom, Security and Justice.
