This paper discusses restructuring the European Commission in the area of justice and home affairs. The author argues that the division between ministries of justice and the interior in most EU countries should also be applied to EU level governance. For the author, this is a question of checks and balances. It is suggested that the EU creates a "Directorate General for Justice," which would be responsible to an independent "Commissioner for Justice." This restructuring could take place with the Commission's next term in 2009.
