This brief argues that the EU’s responses to the refugee crisis have been hampered by three major impediments – 1) disunity within the Union, which stems from the polarization of national interests; 2) the policy gap that exists between protecting the rights of asylum-seekers and fighting human smuggling networks; and 3) limitations in the legal definitions and criteria that are being used to determine a person’s refugee status.
