This paper explains the legal and political frameworks used to prosecute dual-use trade control violations in the EU, specifically in the case of WMD technologies. In doing so, it reflects on the difficulties of translating political-legal terms and concepts into effective enforcement practices at the regional and national levels. Finally, it reviews actual WMD proliferation cases that have been pursued by a number of EU countries and the difficulties of obtaining actual prosecutions.
